Terms of Service
Effective date: 24 May 2026
These Terms of Service (“Terms”) form an agreement between you and RS Buildcon (“RS Buildcon”, “we”, “us”) and govern your access to and use of the RS Buildcon Site Inspection mobile application and related backend services (collectively, the “Service”). By installing, accessing, or using the Service, you agree to these Terms.
1. Eligibility
You may use the Service only if you are at least 18 years of age and have been authorised by an organisation administrator to access it. The Service is intended for professional construction-management use.
2. Accounts and access
- Each user is granted access through an organisation administrator. Your role (Admin, Manager, Site Engineer, Accountant, Member) determines what you may see and do inside the App.
- You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.
- You agree to provide accurate identity, contact, and project information.
- If you suspect unauthorised use of your account, notify your organisation Admin and email rsbuildcon7272@gmail.com or developer.nhjoshi@gmail.com immediately.
3. Acceptable use
You agree not to:
- use the Service for any unlawful, fraudulent, or harmful purpose;
- attempt to access data belonging to organisations or users you are not authorised to view;
- upload content that is unlawful, defamatory, infringes intellectual property rights, or contains malware;
- falsify attendance, location, photos, or any operational record;
- copy, decompile, reverse engineer, or attempt to extract source code, except to the extent permitted by applicable law;
- probe, scan, overload, or interfere with the Service or the underlying infrastructure;
- resell, sub-license, or commercially redistribute the Service to third parties without our written agreement.
We may suspend or terminate access at any time if we reasonably believe you have breached these Terms.
4. Your content
You and your organisation retain ownership of the operational data, photos, and other content you submit to the Service (“Customer Content”). You grant RS Buildcon a limited, non-exclusive licence to host, store, transmit, display, and process the Customer Content solely as needed to provide the Service, generate exports and reports for you, and meet our legal obligations.
You are responsible for ensuring that:
- you have the rights and consents needed to upload any photo, document, or personal data;
- the Customer Content does not violate any law or third-party right;
- the photographs of individuals (for example attendance selfies) are captured with the subject’s knowledge.
5. Our content and intellectual property
The Service, including the App, the backend, the user interface, design, source code, documentation, and trademarks, is owned by RS Buildcon and its licensors. Except for the rights expressly granted in these Terms, no licence to any intellectual property is granted to you.
6. Service availability and changes
- We will use reasonable efforts to keep the Service available, but we do not guarantee uninterrupted or error-free operation.
- We may update, change, suspend, or discontinue features at any time. Where a change materially reduces functionality you depend on, we will give reasonable notice through the App, by email, or both.
- Scheduled maintenance and emergency maintenance may temporarily make the Service unavailable.
7. Beta features
Some features may be labelled “beta”, “preview”, or “experimental”. These features are provided as is, may be unstable, and may be changed or removed without notice. Do not rely on beta features for production-critical workflows unless we expressly confirm they are ready for general use.
8. Third-party services
The Service relies on third-party providers including, but not limited to, Cloudflare, Google Firebase, and PostHog. Your use of features that depend on those providers is subject to their respective terms. We are not responsible for the acts or omissions of third parties.
9. Fees
Where the Service is offered to your organisation under a separate commercial agreement, the fees, billing terms, and payment obligations in that agreement apply. As an individual user, you are not charged directly for the Service; your organisation is responsible for any applicable fees.
10. Termination
- Your organisation Admin may revoke your access at any time.
- We may terminate or suspend access if you breach these Terms, if required by law, or if the organisation’s account is terminated.
- On termination, your right to use the Service ends. Sections of these Terms that by their nature should survive termination (ownership, disclaimers, limitation of liability, indemnity, governing law) will continue to apply.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, RS Buildcon disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Service will be uninterrupted, secure, or free of errors, or that defects will be corrected.
You are responsible for verifying critical operational decisions (payments, billings, reconciliations) before acting on them.
12. Limitation of liability
To the maximum extent permitted by law, RS Buildcon will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, business, goodwill, data, or use, arising out of or in connection with the Service, even if advised of the possibility of such damages.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the smallest extent permitted by law.
13. Indemnity
You agree to indemnify and hold RS Buildcon harmless from any claim, damage, loss, liability, cost, or expense (including reasonable legal fees) arising out of or related to (a) your breach of these Terms; (b) your misuse of the Service; (c) your violation of any law or third-party right; or (d) any Customer Content you submit.
14. Governing law and dispute resolution
These Terms are governed by the laws of India. The courts of Ahmedabad, Gujarat will have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service, except where applicable law gives consumers a non-waivable right to bring proceedings in another forum.
15. Changes to these Terms
We may update these Terms from time to time. The “Effective date” at the top reflects the latest version. Where changes are material, we will notify you through the App or by email before the changes take effect. Continued use of the Service after a change indicates acceptance of the updated Terms.
